High Speed Internet Service Annual Subscription Agreement
By ordering Copper Mtn. CMD Internet’s
“(CMCMDI”) High Speed Internet
Service (“HSIS”) for your
residence or business (your “Unit”),
you agree to:
Annual Subscription Agreement (“ASA”)
By ordering Copper Mtn CMD Internet’s (“CMCMDI”) High Speed Internet Service (“HSIS”) for your residence or business (your “Unit”), you agree to:
- Subscribe for 12 month periods at the initial Monthly Service Cost shown for the Product Package you select. This ASA will renew automatically unless you give us notice via our website (www.resortinternet.com) of your intent to cancel within 60 days of your anniversary date.
- Pay for the CMCMDI cable modem, Product Package, and Installation Option you select.
- Pay for all remaining months of HSIS - due in full, in 1 payment, upon your early termination (the “Early Termination Fee”), if you should cancel for any reason - other than on documented failure by CMCMDI to provide HSIS in an appropriate and consistent manner. If you sell your condo Unit and the new owner agrees to subscribe to our HSIS, your Early Termination Fee will be waived.
- Neither re-sell nor share CMCMDI’s HSIS with anyone outside of your Unit.
Terms of Use (“Terms”)
This High Speed Internet Service ("HSIS") is being provided by CMCMDI, the Homeowner, Lodge, HOA, Property Management Company, ResortInternet and its underlying service providers (collectively the "Providers") for your convenience and use. As a condition of accessing HSIS, you must agree to use HSIS solely for lawful purposes, and you must agree to these Terms of Use. If you do not agree to the TERMS you may not access or use HSIS. If you do use HSIS, you will be deemed to have accepted these TERMS. Any legal issues surrounding using HSIS or not complying with our instructions herein will be your responsibility.
HSIS is provided over a shared Local Area Network (LAN) and is provided and intended as consumer grade HSIS. HSIS is not HIPAA compliant and is not designed to send customer sensitive information such as medical or credit card information, or personal data and is not provided or intended for business uses. If you have critical uses that rely on HSIS, you should retain dial-up backup.
A system firewall has been installed to help prevent computer hackers from entering our HSIS network. It is your responsibility to (a) disable file sharing on your computer while using HSIS; (b) to install a firewall on your computer to ensure its security and contents; and (c) install anti-virus software and keep it upgraded. If your computer is found to be transmitting a virus, we may shut down your access to HSIS until you remove the virus. You may not share HSIS with, or resell HSIS to, anyone outside your condo Unit. If you install Wi-Fi in your condo Unit, you need to use encryption for your own data security and to prevent other users outside your Unit from using your HSIS.
You use our HSIS at your own risk. Providers assume no responsibility for data lost through the use of its HSIS. You should have no expectation that your communications sent or received are private or privileged. You expressly acknowledge and agree there are significant security, privacy and confidentiality risks inherent in accessing or transmitting information through HSIS. These security issues range from interception of transmissions, loss of data, or the introduction of viruses that can damage your computer.
ACCORDINGLY, YOU AGREE THAT NONE OF THE PROVIDERS SHALL BE LIABLE FOR ANY INTERCEPTION OF TRANSMISSIONS, LOSS OF DATA, FILE CORRUPTION, INABILITY TO ACCESS THE INTERNET, HACKING, OR DAMAGE TO YOUR COMPUTER THAT RESULTS FROM THE TRANSMISSION OR DOWNLOAD OF INFORMATION OR MATERIALS THROUGH OUR HSIS.
Copper Mtn CMD Internet’s responsibility
We are responsible for maintaining HSIS to and through your CMCMDI cable modem. You may install any data networking device, other than a server or server software, as long as it does not harm the integrity of our HSIS network, nor interfere with HSIS to other users in the Lodge. We do not support VoIP, audio or video streaming. If your use of these types of applications significantly degrades the speed for other users, you must cease using these applications. We do not support subscriber equipment or software. On-site service calls that we respond to that are caused by your subscriber equipment or software will be charged to you at our current service charges.
By completing the following information, you agree to the Annual Subscription Agreement and Terms of Use as specified herein.
The HSIS services described in this
Agreement are provided and intended
as a consumer grade HSIS. Our HSIS
is not HIPAA compliant, and is not
designed to send customer sensitive
information such as medical or credit
card information or personal data.
Any legal issues surrounding using
our HSIS for such transport will be
your responsibility. If you have any
critical application use that relies
on Internet connectivity, it is recommended
that you retain backup connectivity
alternatives to our HSIS.
Installation Option Information
Self Installation Option
You can pick up your Self Install
Kit at the Copper Mtn CMD Internet
office in Foxpine Inn - 154
Wheeler Place (East Village).
Each Self Install Kit includes a
Copper Mtn CMD Internet activated
cable modem, detailed installation
instructions and all cables needed
for you to install and activate your
HSIS. If you should encounter problems,
you can call our toll-free number
for assistance. If we need to make
an on-site visit to assist you, you
may be charged, depending on the issues
and circumstances. You can install
your HSIS cable modem at any one of
your existing cable television outlets.
Professional Installation
We will install your HSIS cable modem
at any one of your existing cable
television outlets which you specify.
We will ensure that the HSIS connection
is active to and through the Copper
Mtn CMD Internet modem. We will configure
the operating system software (if
required) on one computer to access
the Internet. We will spend up to
one (1) hour on your premises. Your
computer must have an Ethernet connection
or PC Ethernet card installed. Your
computer must be present at the time
of installation in the room you select
for the installation. If we have not
successfully accessed the Internet
using your computer within one hour,
you can request us to continue at
a charge of $65 for each additional
hour (or partial hour) or select your
own computer technician to attempt
to connect your computer to the Internet.
